1. Who we are

The Service is operated by Thieu Tran, an individual developer based in Hanoi, Vietnam("we", "us", "our"). You can reach us at [email protected].

2. Eligibility

You must be at least 18 years old to use the Service. By using it you confirm that you are 18 or older. We ask for your date of birth at sign-up and block accounts for anyone under 18. Where local law sets a higher minimum age, that requirement applies and we may limit or decline service until it is met.

3. Your account

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information, including a date of birth used to confirm eligibility. Tell us promptly at [email protected] if you believe your account has been compromised.

4. The Service

Lingaira is a language-learning service centred on spoken conversation practice with an AI tutor, with feedback, quests, progress tracking and optional community features. We may add, change, suspend or remove features, and set or adjust usage limits by plan. We try to keep the Service available but do not guarantee it will be uninterrupted or error-free, and it may depend on your device, network and third-party services.

5. Licence and intellectual property

We grant you a limited, personal, non-transferable, non-exclusive licence to use the Service for your own language learning, subject to these Terms. The Service, including its software, content, branding and the name "Lingaira", is owned by us or our licensors and protected by law. You may not copy, resell, reverse-engineer or create derivative works from the Service except as the law allows.

6. Your content and AI output

You keep ownership of the content you submit (for example, community posts, messages and uploads). You grant us a licence to host, store, process and display that content as needed to operate and improve the Service and to moderate it. You are responsible for the content you submit and confirm you have the right to submit it.

AI responses are generated automatically for your practice. We do not claim ownership of the output shown to you, and we make no guarantee it is original, accurate or suitable for any purpose.

7. AI-generated content

Lingaira uses AI (Google Gemini) to hold conversations and generate feedback. AI responses may be inaccurate or inappropriate; they are practice aids, not professional, medical, legal, or financial advice. Use judgment when relying on AI output. Speaking practice requires sending your audio and transcripts to our AI provider, as described in the Privacy Policy.

8. Acceptable use and community standards

You agree not to:

• Post or transmit abusive, harassing, hateful, sexual, or unlawful content.
• Attempt to disrupt, reverse-engineer, or overload the Service.
• Impersonate others or misuse community and group features.
• Use the Service to break the law or infringe others' rights.

We moderate community and group content. You can report content or users in the app. We may remove content, hide messages, or suspend or terminate accounts that violate these Terms or applicable law.

9. Subscriptions and payments

Lingaira offers a free tier and paid subscriptions (for example, Premium and Pro). Paid plans are sold and billed through the app store you purchase from (Apple App Store or Google Play) and are subject to that store's terms.

• Auto-renewal: subscriptions renew automatically for the same period and price until you cancel. The store charges you at the start of each period.
• Pricing: current prices, billing period, and any trial or introductory offer are shown at purchase in the app.
• Cancellation: manage or cancel anytime in your app store account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Refunds: refunds are handled by the app store under its policies, and may also depend on mandatory consumer rights where you live.
• Price changes: we may change prices or plan features for future periods; where required, the store or we will notify you and, where required, seek your agreement before a change takes effect.
• Account deletion: deleting your Lingaira account does not automatically cancel a store subscription — cancel it in your store account to stop further charges.

10. Third-party services

The Service relies on third parties (including Google, Apple, RevenueCat and others described in the Privacy Policy). Your use of those services may also be governed by their terms, and we are not responsible for their acts or omissions.

11. Disclaimers and liability

To the extent permitted by law, the Service is provided "as is" without warranties of any kind, and we are not liable for indirect, incidental or consequential losses, or for loss arising from your reliance on AI output. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including mandatory consumer-protection rights.

12. Suspension and termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms or applicable law, or where needed to protect the Service or its users. On deletion, your data is handled as described in the Privacy Policy.

13. Governing law and your consumer rights

These Terms are governed by the laws of Vietnam, without prejudice to the mandatory consumer-protection rights you have under the law of the country where you live, which continue to apply. Where a dispute cannot be resolved informally, it may be brought before the competent courts, subject to any mandatory rules that allow you to bring proceedings in your place of residence. Please contact us first — most issues can be resolved quickly.

14. Changes and contact

We may update these Terms; we will change the effective date above and surface material changes in the app or on our website. Continuing to use the Service after a change means you accept the updated Terms. Questions? Contact [email protected].
